AVIRON reserves the right to accept or decline your order for any reason at its discretion, subject to applicable law. Your order is not accepted until AVIRON confirms acceptance. We must receive and process your payment before your order is accepted. Please review your order carefully before submitting, as AVIRON may be unable to accommodate cancellation requests after an order is accepted. In the event that we do not accept, make a change to, or cancel an order, we may attempt to notify you by contacting the e‚Äëmail, billing address, and/or phone number provided at the time the order was made. Your purchases are subject to return or exchange solely in accordance with our return and refund policy. This does not limit any rights you may have under applicable law. You represent and warrant that your purchases are for your own personal or household use and not for commercial resale or export.

4. Prices and billing

Prices, discounts and promotions are subject to change without notice. The price charged for a product or service will be the price in effect at the time the order is placed and will be set out in your order confirmation email. Unless otherwise expressly stated, posted prices do not include taxes, shipping, handling, customs or import charges. Prices posted in our online stores may be different from prices offered in physical stores or in online or other stores operated by third parties. We may offer, from time to time, promotions on the Services that may affect pricing and that are governed by terms and conditions separate from these Terms of Service. 6. Products for personal use only

Products bought on theaviron.com are for your own personal, non-commercial use. You agree not to resell, redistribute or export them. Products resold outside our authorised channels may have been stored or handled in ways we cannot verify, and are not covered by our guarantee. We may limit or cancel orders that appear to be placed by resellers or distributors.

7. No medical advice

Content on this website is for general information only. It is not medical advice and does not replace advice from a qualified healthcare provider. Speak to your doctor or pharmacist before starting any supplement, especially if you are pregnant, nursing, taking medication or have a medical condition. 8. Individual results

9. Payment

You can opt out of this updating service through your card issuer. If your bank reverses a charge that was valid under these Terms, we may seek payment by other means.

10. Order acceptance

An order confirmation email does not mean we have accepted your order. We may decline or cancel any order for any reason, including suspected fraud, pricing errors or reseller activity. If we cancel an order, we will refund your original payment method in full.

11. Delivery confirmation

Delivery confirmation from the carrier is accepted as proof of delivery to the cardholder, even without a signature.

12. 90-Day Money-Back Guarantee

First-time customers who buy directly from theaviron.com are covered by our 90-Day Money-Back Guarantee, as set out in our Refund Policy. The guarantee applies once per household. Purchases from third-party sellers are not covered.

13. Subscriptions

Subscription orders renew automatically and are billed at the stated price and frequency until cancelled, as set out in our Subscription Policy. You can cancel at any time in your customer portal or by emailing support@theaviron.com.

14. Testimonials, reviews and submissions

Anything you send or post to us, including reviews, photos, testimonials, comments and ideas ("Submissions"), is non-confidential. You give us a worldwide, royalty-free, perpetual, irrevocable licence to use, copy, edit, publish and display your Submissions, with your first name and last initial, in any media, including advertising. You confirm that your Submissions are your own and do not infringe anyone else's rights.

15. Social media

Comments posted by users on our social media pages are the views of those users, not AVIRON. Each platform has its own terms and privacy policy.

16. Shipping and delivery

Except as otherwise stated, we are not liable for shipping and delivery delays. All delivery times are estimates only and are not guaranteed. We are not responsible for delays caused by shipping carriers, customs processing, or events outside our control. To the fullest extent permitted by applicable law, title and risk of loss pass to you when we transfer products to the carrier, unless applicable law provides otherwise. We are not responsible for delays or failures caused by events beyond our reasonable control, including carrier or customs delays, natural disasters, severe weather, labor disputes, supply shortages, utility or telecommunications outages, cyber incidents, governmental actions, or other similar events. Our Services, including but not limited to all trademarks, brands, text, images, graphics, product reviews, video, and audio are owned by AVIRON, its affiliates or licensors and are protected by U.S. and foreign trademark, copyright and other intellectual property laws. Similarly, the product listings are managed and owned by AVIRON. The purchase or delivery of any product does not grant or confer any intellectual property rights, including any patent, copyright, trademark, or other proprietary right, in or to the product, its design, software, or underlying technology. All such rights remain exclusively with AVIRON or the original rights holder. These Terms permit you to use the Services for your personal, non-commercial use only. Unauthorized use of the Services may violate applicable intellectual property or other laws. All rights not expressly granted herein are reserved by AVIRON. AVIRON's names, logos, product and service names, designs, and slogans are trademarks of AVIRON or its affiliates or licensors. You must not use such trademarks without the prior written permission of AVIRON. Shopify's name, logo, product and service names, designs and slogans are trademarks of Shopify. All other names, logos, product and service names, designs, and slogans on the Services are the trademarks of their respective owners.

18. Optional tools

You may be provided with access to customer tools offered by third parties as part of the Services, which we neither monitor nor have any control nor input. You acknowledge and agree that we provide access to such tools "as is" and "as available" without any warranties, representations or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools. AVIRON is powered by Shopify, which enables us to provide the Services to you. When you use the Services, your device communicates with Shopify’s systems to deliver the Services. Section 21 explains how Shopify uses and processes information from these interactions. However, any sales and purchases you make in our Store are made directly with AVIRON. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and AVIRON, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with AVIRON.

13.2 In addition, you agree not to: (a) upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the Services; (b) reproduce, duplicate, copy, extract, sell, resell or exploit any portion of the Services; (c) collect or track the personal information of others; (d) spam, phish, pharm, or pretext the services; (e) use any robot, spider, scraping, data gathering and extraction tools, automatic devices or processes, AI tools (such as agentic AI) or automated or manual means to access the Services; or (f) interfere with, bypass, or circumvent the security or authorization features, robot exclusion headers, or other measures we employ to restrict access to the Services. We reserve the right to suspend, disable, or terminate your account at any time, without notice, if we determine that you have violated any part of these Terms.

25. Agents

We may terminate this agreement or your access to the Services (or any part thereof) in our sole discretion at any time without notice, and you will remain liable for all amounts due up to and including the date of termination. The following sections will continue to apply following any termination: Intellectual property, Feedback, Termination, Disclaimer of warranties, Limitation of liability, Indemnification, Severability, Waiver; entire agreement, Assignment, Governing law, Privacy policy, and any other provisions that by their nature should survive termination.

27. Disclaimer of warranties

The information presented on or through the Services is made available solely for general information purposes. We do not warrant the accuracy, completeness, or usefulness of this information. Any reliance you place on such information is strictly at your own risk. EXCEPT AS EXPRESSLY STATED BY AVIRON, THE SERVICES AND ALL PRODUCTS OFFERED THROUGH THE SERVICES ARE PROVIDED 'AS IS' AND 'AS AVAILABLE' FOR YOUR USE, WITHOUT ANY REPRESENTATION, WARRANTIES OR CONDITIONS OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING ALL IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, MERCHANTABLE QUALITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE, REPRESENT OR WARRANT THAT YOUR USE OF THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE. SOME JURISDICTIONS LIMIT OR DO NOT ALLOW THE DISCLAIMER OF IMPLIED OR OTHER WARRANTIES SO THE ABOVE DISCLAIMER MAY NOT APPLY TO YOU.

28. Limitation of liability

TO THE FULLEST EXTENT PROVIDED BY LAW, IN NO CASE SHALL AVIRON, OUR PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS OR LICENSORS, OR THOSE OF SHOPIFY AND ITS AFFILIATES, BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING, WITHOUT LIMITATION, LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA, REPLACEMENT COSTS, OR ANY SIMILAR DAMAGES, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE, ARISING FROM YOUR USE OF ANY OF THE SERVICES OR ANY PRODUCTS PROCURED USING THE SERVICES, OR FOR ANY OTHER CLAIM RELATED IN ANY WAY TO YOUR USE OF THE SERVICES OR ANY PRODUCT, INCLUDING, BUT NOT LIMITED TO, ANY ERRORS OR OMISSIONS IN ANY CONTENT, OR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF THE USE OF THE SERVICES OR ANY CONTENT (OR PRODUCT) POSTED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA THE SERVICES, EVEN IF ADVISED OF THEIR POSSIBILITY. NOTHING IN THESE TERMS OF SERVICE EXCLUDES OR LIMITS LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

To the maximum extent permitted by law, our total liability for any claim relating to these Terms, the website or our products is limited to the greater of the amount you paid for the product in question or USD $500. Nothing in these Terms limits liability that cannot be limited by law, including your statutory rights as a consumer in the United Kingdom or Canada.

Our responsibility to customers in the United Kingdom

If you are a consumer in the United Kingdom, this section applies to you in place of the liability cap above.

• We are responsible for loss or damage you suffer that is a foreseeable result of us breaking these Terms or failing to use reasonable care and skill. Loss is foreseeable if it was obvious it would happen or if both of us knew it might happen when you placed your order.
• We are not responsible for loss or damage that was not foreseeable.
• Our products are for domestic and private use only. We are not liable to you for any loss of profit, loss of business, business interruption or loss of business opportunity.
• We do not exclude or limit our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for breach of your legal rights in relation to the products (including the right to receive goods that are as described, of satisfactory quality and fit for purpose), or for defective products under the Consumer Protection Act 1987.
• Subject to the point above, our total liability to you for any other claim relating to an order is limited to the price you paid for that order.

29. Indemnification

You agree to indemnify, defend and hold harmless AVIRON, Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from any losses, damages, liabilities or claims, including reasonable attorneys' fees, payable to any third party due to or arising out of (1) your breach of these Terms of Service or the documents they incorporate by reference, (2) your violation of any law or the rights of a third party, or (3) your access to and use of the Services. We will notify you of any indemnifiable claim, provided that a failure to promptly notify will not relieve you of your obligations unless you are materially prejudiced. We may control the defense and settlement of such claim at your expense, including choice of counsel, but will not settle any claim requiring non-monetary obligations from you without your consent (not to be unreasonably withheld). You will cooperate in the defense of indemnified claims, including by providing relevant documents.

30. Severability

In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions. Nothing in these Terms limits any rights you may have under applicable consumer protection laws or other laws that cannot be waived by contract. If any part of these Terms conflicts with those rights, those rights will apply.

31. Waiver; entire agreement

The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision. These Terms of Service and any policies or operating rules posted by us on this site or in respect to the Service constitutes the entire agreement and understanding between you and us and governs your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service). Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party.

32. Assignment

You may not delegate, transfer or assign this Agreement or any of your rights or obligations under these Terms without our prior written consent, and any such attempt will be null and void. We may transfer, assign, or delegate these Terms and our rights and obligations without consent or notice to you.

33. Dispute resolution (United States customers)

If you live in the United States, you and AVIRON agree to resolve any dispute relating to these Terms, our products, our marketing or our Privacy Policy through binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, instead of in court. Neither you nor we may bring or join a class action, class arbitration or representative action. This section is governed by the Federal Arbitration Act.

You can opt out of arbitration within 30 days of your first purchase by emailing support@theaviron.com with your name, order number and a statement that you opt out of arbitration.

Either party may still bring an individual claim in small claims court, and AVIRON may seek court relief to protect its intellectual property.

34. Governing law

These Terms are governed by the laws of Canada and the province in which AVIRON is registered. If you are a consumer in the United Kingdom or European Union, you also keep the protection of the mandatory consumer laws of the country where you live, and you may bring a claim in your local courts.

35. Translations

The Terms of Service may be available in languages other than English. To the extent of any inconsistencies or conflicts between these English Terms of Service and Terms of Service available in another language, the most current English version of the Terms of Service will prevail. Any disputes arising out of these Terms of Service will be resolved in English unless otherwise determined by AVIRON (acting in its sole discretion) or as required by applicable law.

36. Headings

The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.

37. Electronic communications

By using the Services or placing an order, you agree that we may send you transactional and service-related communications electronically, including by email, in-account notice, or posting on the Services. These communications may relate to your orders, account, purchases, returns, these Terms of Service, or other Services-related matters. You are responsible for keeping your contact information current.
